Terms of Service

1. Acceptance of Terms

By accessing or using iCanPass, you agree to be bound by these Terms of Service. If you do not agree, please do not use the platform. These terms apply to all users including students, parents, guardians, teachers, and sponsors.

2. Account Registration

Parents and guardians are responsible for creating and managing accounts for themselves and any minor dependents. You must provide accurate, complete, and up-to-date information during registration. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

3. User Responsibilities

You agree to use iCanPass only for lawful educational purposes. You must not: misuse the platform in any way that could damage or impair it; attempt to gain unauthorised access to other users' accounts or data; use the platform to transmit harmful, offensive, or illegal content; or interfere with any other user's enjoyment of the platform.

4. Payments and Subscriptions

Certain features of iCanPass require a paid subscription. Subscription fees are payable via PayFast or other payment methods made available on the platform. All fees are quoted in South African Rand (ZAR) and are non-refundable except as required by the Consumer Protection Act, 2008. It is your responsibility to ensure that payment information is accurate and that sufficient funds are available. iCanPass reserves the right to change subscription fees with reasonable notice.

5. Student Data and Test Results

Test results, progress reports, and student profile information are generated based on platform usage and assessments. While iCanPass strives for accuracy, test scores and learning recommendations are supplementary tools and should not be treated as the sole measure of academic achievement. Data is stored and processed in accordance with our Privacy Policy and the Protection of Personal Information Act (POPIA).

6. Acceptable Use and Conduct

Users must not: cheat or manipulate test-taking features; reverse-engineer, decompile, or attempt to extract the source code of the platform; use automated scripts, bots, or scrapers; or impersonate other users or provide false information. Violation of these acceptable use terms may result in account suspension or termination.

7. Intellectual Property

The iCanPass platform, including its name, logo, design, software code, and pre-loaded test content, is the intellectual property of iCanPass and its licensors. You may not copy, modify, distribute, or create derivative works based on the platform without prior written consent. Any content you upload or create within the platform remains your property, subject to a licence to iCanPass to host and deliver it.

8. Limitation of Liability

iCanPass is provided on an 'as is' and 'as available' basis. To the fullest extent permitted by South African law, iCanPass and its affiliates shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of data, loss of profits, or interruption of service, arising from your use of or inability to use the platform.

9. Termination

You may stop using iCanPass at any time. iCanPass reserves the right to suspend or terminate your account if you violate these terms, with or without notice. Upon termination, your right to access the platform will cease immediately. Data retention after termination is governed by our Privacy Policy.

10. Governing Law and Contact

These Terms of Service are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the South African courts. For questions about these terms, please contact us at info@icanpass.co.za.
